The United Nations is an organization of sovereign states. HK can never be a signatory of any of the treaties.
It is true that RELEVANT provisions of such international covenants should be applied to HK, according to Basic Law passed by PRC, a sovereign state. Yet, the covenants in themselves cannot be applied in HK (correct me if I am wrong), unless they are 'localized' by the local legislature. At present, though China is a signatory to some of these human right covenants, she hasn't 'localized' many of them, and thus, the mainland Chinese people cannot use it to challenge the Chinese government in court.
So, for the sake of argument, if taking the exam were a right, the students and their parents should take the school to court (in judicial review) and seek compensation from the school. This will set things straight and shut us all up.
