API of 831, what does it means?

Thanks very much, very helpful.

We will be landing in California on June of 2008.  Only my elder son aged 13 now will stay there for studying with the care by our sister who are the citizen over 20 years.  We include my little son want back to H.K. for working 3 - 5 years before living there for good.

Do you think it will affect my elder son's residence status and free education while we work and pay foreign tax?  For my children who cab have better fee charge in University, should we pay foreign tax or state tax is better?

Hope you can share your know-how to me.  I am quite confused.

It is going to affect your son's residency and free education.
照你比既資料 ﹐  你應該系以移民身份過去。你兒子未夠 18 years old ( I forgot if it needs to be 18 or 21, but your son is neither), 應該系按照父母既 status. 即距系跟你地既。如果萬一你地被除消 green card, 你兒子應該系會被影響。但如果你地可以堅持每半年過去美國留返幾個禮拜 ﹐  甘應該就吾會甘容易被除消 green card 既﹐  如果申請左回美證 ﹐  甘就會更加穩陣。
至於 free education, 如果你地一路系系香港工作 ﹐  一直到你兒子讀大學都系既話 ﹐  甘距系享受吾到平學費 (我自己以前就系 ﹐  我都系系加州讀大學 ﹐  父母系系香港做工 )﹐  因為你的收入系支持你兒子生活費﹐  而你 file foregin tax, 所以你兒子讀大學都要比 international student 既學費。直到你兒子可以獨立﹐  即距可以 proof 自己有收入 (比如話距系做 part time, 或者有獎學金﹐  幫 prof. 做 research 等等 )﹐  距就可以以距個人身份而享有到平學費。即距經濟上吾再依靠父母。

如果你系香港做工 ﹐  甘系應該交 foregin tax. 雖然系吾可以比平學費 ﹐  但 on the other side 你又省左 tax, 其實 2 邊都差吾多。

You mentioned that a stay of few weeks out of every half year to maintain the Green Card, can this few weeks be on accumulative base out of one year time? What is the rationale behind for this or any written immigration guidline on holding the Green Card status? What is the grade for Hign School in California, 1 to 12 or 13?

其實每半年返美國基本上系保險既規矩。你太耐吾入境 ﹐  距有權取消你既綠卡 ﹐  我聽過 case 系即場收綠卡然後比返個旅游簽証你﹐ 甘你就喪失左個居留權。
當然﹐  收吾收綠卡呢 D 真系好 subjective, depends on 個個官既睇法﹐ 距心情 ﹐ 你既態度。建議你每半年返去幾個禮拜已經系最低要求甘滯﹐ 因為如果你每半年 /5個月先出現一次 ﹐  距一樣可以話你﹐  可以話你無誠意長期留系美國定居 etc....(我承認﹐  真系好鬼麻煩)
所以拉 ﹐  基本上就吾可以 accumlate 做一年﹐  其實距系真系有規矩話你吾可以離境超過半年架﹐  只不過好多時候 D 人會同距講自己只走左 5 個月 ﹐  或者入境處頭 1﹐ 2 次會放過你 (當然少不免又被距話一餐)﹐  但長遠計﹐  一年返一次美國系行吾通。
如果你真系要一年返一次 ﹐  就申請回美證 ﹐  一申請就有效 2 年 (有可能 1 年 )﹐  甘就算你 2 年後先返去都 OK。不過 ﹐  問題系你仔先 13 yrs old, 有排讀﹐  你起碼要支持到你個 green card status 5 年(如果計算你兒子 18 獨立﹐  如果計 21 就要 8 年)。可吾可以 5 年內不斷 renew re-entry permit 而距又次次都批比你呢 ? 甘我就吾知道了。

美國系行 4 年大學制度
去到 Grade 12 High school 系由 9 年班開始﹐  即 15 years old.
距地系有分 junior high 同 high school, 每樣都系 4 年。

What is private academy? I note that there are private academy under the public school list. Any international English test / examination should be done in H.K. for better chance of addmission to good high school?
