No Verb "is" in both sentences.
First one, 冇 specify 到那一個男人。
second one, 指明這個那人，如前面句子已講過個男人既，跟住用 the man 就OK

我覺得一係

1. A man who sits /who is sitting..... next to John 指出在John 身旁有個男人坐著
2. The man who sits / who is sitting....... next to John 指出Jonh 身旁坐著的"那個"男人

or A man /The man sits next to John.

or A man/The Man is sitting next to John.
