Dear parents,
I have problems in UK VISA application, hope to seek your opinion.

Background:

CAS course date: 01/09/2015 to 07/07/2018; school term starts 08/09/2015. We have been advised by the school to arrive on 04/09/2015.

I have submitted the VISA application 2 weeks ago as this link says we could apply 3 months earlier.

However, yesterday I received deferral email from the VISA office:

quote:

"We are contacting you regarding to your Tier 4 (Child) Student visa application.  With the recent introduction of Biometric Residence Permits (BRPs) for long-term (more than 6 months) stays in the UK, you will now only be granted a 30-day Entry Clearance during which time you must travel to the UK.  You will then have 10 days after entry to the UK to collect your BRP from your designated Post Office.

The Immigration Rules state that your Entry Clearance must be valid for one month prior to the start date on your Certificate of Acceptance of Studies (CAS).  In your case, this means that your 30-day Entry Clearance will have expired prior to your intended travel date.  You therefore have two options:

1. You can withdraw your application and re-apply nearer the time of intended travel date (within one month of your intended travel date).  Your application fee will be refunded.
2. We can put your application on hold until we receive further policy guidance which may allow us to grant your visa to allow you to travel as planned.

Your application will not be processed further at this time and the second option will apply unless you confirm that you wish to withdraw your current application."

I have made contact with my local adviser, she suggests I change the date of my travel to before 01/09/2015 would help. (I am not very convinced that this is the reason otherwise option 1, that I could apply later again won't help; and all the air tickets have been booked.) I have also sent mail to VISA office to clarify.

They have to grant the clearance permit starting now or the can specify the starting date to match my travel date? Any input from parents here for what have gone wrong?

Do you mean that you received an e-mail before you collect the visa? What is your problem? valid period problem?

VISA office sent me email informing me that the application is deferred, for reason that I can't understand.

我收到的信大致上講女的申請已經成功，批出時期是邊段時間，要求女兒到達UK時10日內要到指定郵局領取BRP, 否則，Visa會當作冇效，另外一提，取回Passport時，貼在上面的Entry Clearance 只有一個月，要係呢個月入UK境，agent話到時過境帶埋CAS +Visa 中心的信+parents letter，関員便會在Passport上蓋上有関批核年期。

Yes 30days it is not base on the flight date. My agent will due with embassy and keep me inform for the new status. I heard many parents have the same problem.

Passport 上的Entry Clearance 5/8/2015 - 4/9/2015. 而我的機票是26/8/2015

That means many parents apply in June and they will grant the clearance permit starting from August?

Then who and how to decide the clearance period? VISA office will decide for you or there is a field for the applicant to fill in?

I apply in June, appointment on 13/6. Flight date filled as 4/9/2015.
We apply by ourselves.

That means if CAS starts on 01/09/2015 then I should apply after 01/08/2015?
If yes then why Umi 's application would be successful? (so are many other applicants)

When did you indicate you will travel?

Your CAS date is from 1/9/2015. It says "your Entry Clearance must be valid for one month prior to the start date on your Certificate of Acceptance of Studies (CAS)". So the Entry Clearance for you would be 1/8/2015 - 1/9/2015.

Did you indicate you will travel after 1/9/2015?

Changing the form only would not help. Your Entry Clearance will still be 1/8/2015 - 1/9/2015. You have to arrive in August.

So amend the arrival date on the form. And change air ticket as well.

I didn't mean the date you apply for your visa. I think no matter when you apply(the earliest is 3 months before the school start) the visa they will base on CAS

其實CAS date係1/9，咁佢一定預你31/8前抵達UK的，或者可否叫學校改返個CAS date? 如果5可以的話，咁改機票係唯一選擇！可能領事覺得CAS date係1/9，冇理由你會遲過從呢個date入境。
我CAS date係2/9/2015，所以我見個entry clearance是1/8-1/9。

However, if the CAS date and arrival date is the main reason, then why the options provided by the VISA Office for me will work?

This is my understanding:

If the clearance is one month, so if you apply, say on 10/8, the period allowing you to reach UK must be after 10/8, the clearance period will be like 10/8-9/9, then it can fulfill the date that you arrive UK and start your study on 4/9.

Not sure it is correct or not.

換句話說如果我3/7去做應該會reject, 因為我的入境日子係2/9。
因個人問題，我只有兩個日子去做證，一係3/7, 一係19/8或以後。咁情況下我就要揀19/8後做至可以達到30 days clearance。到時又要做priority service 了。
一心諗住早D完成左，了左件事，好煩！

我再上UK網上睇，大意係如沒有在網上填表的，就要下載和填，如已網上填了表，也要印份表出來，但佢沒講過要填，但亮兄都有講，填埋佢冇壞，另外我在護照國籍寫了中國，其實應該寫香港的，但寫了沒辦法。

新政策只會批一個月內入境英國，比如1/8-1/9一定要入境英國，但是你機票買咗3/9，咁埋有問題囉，明唔明？

見到你的 case令我都好擔心visa 批的入境日期。亞女開學是7 Sep, 但summer course 的date 是 3 Aug （summer course 的CAS和機票有比visa centre, 我亦寫咗到境日期是3 Aug).這樣批3/8入境機會大吾大？

學校是親戚介紹，再自己入學校網報名，地點在BLACKPOOL.讀A-LEVEL，全樣國際生都唔知有冇十人，香港可能得我女兒一個都未定。

The staff of visa centre do not ask you for the supporting docs. Their duty is just collecting the forms. If you ask them whether you should submit, for example, flight itinerary. They just only say it‘s up to you. They won’t give you any advice.

As I through agent applied the visa and agent told me it is not necessary to submit air ticket to the consulate. Anyway, I copied full set of the application form and the documents I needed to submit to consulate for my record, but I couldn't find the copy of air ticket.
