我個仔2年前係HK F.5 畢業去左美國讀COLLEGE, 到依家仲係收緊外地生學費, 佢係美國公民, 知唔知有也途徑申訴. COLLEGE 話佢要有報稅先得, 但佢係學生, 冇做野, 點報稅即. 有冇人知道搵邊D 人可以幫倒手 .TKS

Just wondering how old your son is? If he is not old enough, I think what the college means is that your family has to pay tax before your son can be considered resident. This is the same case as in Canada.

You should ask your son to check with the college he's attending on how they define resident and non resident, and how to qualify as resident.

I think the school means that if your son is not an adult yet, parents have to file tax return and pay tax to get local school resident benefits. This is the same rule as in Canada or UK.

he attend college when he is 17 yrs, but after a year, he is already adult, he is still asked to pay non residence fee, the college said he has to file tax return, however, my son is studying and has no work, how can he file tax return .
I don't know what is the actual reason for not qualifying as resident . I want to get someone to help.

You can file a tax return even if you do not have any income.

Totally agree, even if your son holds a US citizenship, different state colleges has different residency regulations(something like how long you've been living in the same states, weather the student's family had paid taxes before).
You better ask your son to check with the school officials or check it from the school's website. The rule should be very clearly state how a student qualified to pay in-state tuition.

he is attending Foothill college in califorina, this year, my brother claim him as dependent in tax return, i ask my son to present this information to college to prove that he has intention lived in california.

Actually , I like De Anza College more than foothill, because foothill have more HK Student than De Anza , they are always talked about HK where to playor planing what gonna to do after back HK in summer. Sounds like not concentrate on studies.

Thank for your link, I check with one of the following, since my son already living in california for more than 2 years, he was claim as an dependent in my brother's tax return for year 2010/11, my brothers is in california more than 10 years, what do you think is my son apply to the follwing clause ?
Dependent Child of a California Resident. A student who has not been an adult resident of California for more than one year, and is the natural or adopted, dependent child of a California resident who has been a resident for more than one year immediately prior to the residence determination date. I am not an expert of that but I would recommend your son to talk to respective officer in Foothill to get a clear idea what they need from him to meet the CA residency qualification.
BTW, I have visited De Anza a few times this summer as well since my girl was attending a sport camp there.
I talked to a few local people in that area and all said De Anza should be a better choice as a Community College acadamically.

Is your daughter also study in California college?
Is she the same case as me?
I hope my son can finished his college by 2 years then transfer to U .

My daugther is studying IB MYP only and we would not send her aboard until a few years later .
FYR, there is a TAG (Transfer Admission Guarantee ) program in the UC system. Seven UC campuses offer guaranteed admission to California community college students who meet specific requirements. See if that can help.

I hope the info may help other parents /students as well. Berkeley and Stanford are very popular ones but they may not be the best choice for every family.
